Welcome to www.thewell-md.com (the "Site"), operated by The Well MD, a direct primary care and aesthetics practice located at 30 Parkway Commons Way, Greer, SC 29650, USA ("The Well MD", "we", "us", "our"). These Terms and Conditions ("Terms") govern your use of the Site. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
1. The Site is for general information only
The Site describes our services, membership options, team and practice, and publishes general health and wellness articles. This content is provided for general information and education. It is not medical advice, it is not a substitute for a consultation with a physician, and it does not take your individual circumstances into account.
- Using the Site does not make you a patient. No physician-patient relationship is created by reading the Site, sending a message through it, or booking an appointment online. A physician-patient relationship is formed only when you enroll as a member or are seen by our physician.
- In an emergency, call 911. Do not use the Site, its contact forms or email for urgent or emergency medical needs. Contact forms are not monitored around the clock.
- Do not send health information through the Site. Our contact forms and ordinary email are not intended for personal health information. For questions about your care, call the office or use your patient portal.
Health information changes over time. We try to keep the Site accurate and current, but we make no guarantee that any article, price or description is complete or up to date.
2. Membership, appointments and payments
The Site does not process enrollments, appointments or payments itself. Links on the Site take you to services operated by other companies:
- Hint Health: membership enrollment, membership fees and other payments, appointment booking and the patient portal.
- Microsoft Bookings: scheduling a free Meet & Greet.
Those services have their own terms and privacy policies, which apply when you use them. Your membership with The Well MD is governed by the Patient Membership Agreement you sign at enrollment, not by these Terms. If anything in these Terms conflicts with your Patient Membership Agreement, the Patient Membership Agreement controls.
We are a direct primary care practice and do not bill or accept health insurance, including Medicare. Many medical services can be paid for with Health Savings Account (HSA) or Flexible Spending Account (FSA) funds; eligibility is determined by your plan administrator, not by us. Prices shown on the Site are current at the time of publication, may change, and are confirmed at enrollment or at your visit.
3. Aesthetic services
Descriptions of aesthetic treatments (such as Botox, fillers, PDO threading, microneedling, chemical peels, facials, ear piercing and sclerotherapy) explain what a treatment generally involves. Individual results vary. Whether a treatment is appropriate for you is decided at an in-person consultation, and any consent form you download from the Site is for your convenience only. Informed consent takes place in the office before treatment.
4. Contact forms and communications
When you use the Contact Us or Partner With Us form you agree to provide accurate information and to use the forms only for genuine enquiries. You must not use them to send spam, advertising, abusive or unlawful content, or automated submissions. By providing an email address or mobile number you agree that we may reply to you at that address or number. How we handle information you send is described in our Privacy Policy.
5. Downloadable forms and documents
The Site provides certain documents for download, such as our Notice of Privacy Practices and consent forms. You may download and print them for your own use in connection with our services. They may be updated from time to time; the version provided in the office at the time of your visit is the version that applies.
6. Intellectual property
Unless otherwise stated, The Well MD or its licensors own the text, photographs, videos, graphics, logo and other material on the Site. You may view, download and print material from the Site for your own personal, non-commercial use. You may not otherwise copy, republish, sell, distribute or modify material from the Site, or use our name or logo, without our prior written permission.
"The Well MD" and our logo are our marks. Botox®, SkinPen®, Emcyte and Blomdahl are marks of their respective owners, used on the Site only to identify the products and equipment we use; no affiliation or endorsement is implied.
7. Acceptable use
You agree not to:
- interfere with the operation or security of the Site, or attempt to bypass any security measure or rate limit;
- use robots, scrapers or other automated means to access the Site or submit forms, other than search engines indexing public pages;
- introduce malware or any harmful code;
- impersonate any person or misrepresent your affiliation with any organisation;
- frame the Site, or link to it in a way that is deceptive or implies our sponsorship or endorsement.
You may link to public pages of the Site in a fair and lawful way that does not damage our reputation or suggest an association that does not exist. We may ask you to remove a link at any time.
8. Third-party websites and services
The Site contains links to websites and services operated by others, including Hint Health, Microsoft Bookings, Google Maps, social media platforms and product manufacturers. We do not control those sites and are not responsible for their content, availability, terms or privacy practices. A link does not mean we endorse the site.
9. Disclaimer of warranties
The Site is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, express or implied, about the Site or its content, including that the Site will be error-free, uninterrupted or free of viruses, or that its content is accurate, complete or current.
10. Limitation of liability
To the fullest extent permitted by South Carolina law, The Well MD, its physician, staff and contractors will not be liable for any indirect, incidental, consequential or special damages, or for any loss arising from your use of, or inability to use, the Site or any content or third-party service linked from it.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including our obligations to you as a healthcare provider and any rights you have under your Patient Membership Agreement.
11. Indemnity
You agree to indemnify The Well MD against claims, losses and reasonable costs arising from your breach of these Terms or your misuse of the Site.
12. Privacy
Our Privacy Policy explains what information the Site collects and how we use it. Our Notice of Privacy Practices explains how medical information about you may be used and disclosed under HIPAA. Both form part of these Terms.
13. Changes to these Terms
We may revise these Terms at any time by posting the updated version on this page with a new Revised date. Your continued use of the Site after a change means you accept the revised Terms.
14. Governing law
These Terms are governed by the laws of the State of South Carolina and applicable United States federal law, without regard to conflict-of-law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Greenville County, South Carolina, and you consent to the jurisdiction of those courts.
